2. Purpose of the website
Blackfeet Investment provides property marketing, enquiry coordination and opportunity-discovery services. The website helps prospective buyers and renters connect with property owners, landlords or authorized representatives. Availability and the precise role Blackfeet plays may differ between transactions.
3. No automatic transaction
Submitting a form, joining a rental alert, clicking a WhatsApp link or receiving property information does not create a sale, tenancy, agency, reservation, exclusivity agreement or guarantee of availability. A binding transaction arises only from appropriate written agreements between the relevant parties.
4. User responsibilities
You must provide accurate, current information and use the website lawfully. You must not impersonate another person, submit property without authority, upload misleading photographs, conceal material facts, compromise the website, scrape data at scale or use the service for fraud, spam or unlawful discrimination.
5. Property submissions
By submitting a property, you confirm that you own it or are authorized to market it, that the information is accurate to the best of your knowledge and that Blackfeet may review, edit for clarity, reject, publish, promote or remove the listing. Submission does not guarantee publication or enquiries.
When requested, you must submit genuine, current identity and authority evidence through the private provider-verification form. Representatives must identify the owner or appointing party and permit Blackfeet to contact that person. Forged, altered, borrowed or misleading documents, false declarations and impersonation are prohibited and may lead to rejection, account restriction, evidence preservation and referral to relevant authorities. Blackfeet verification is an internal risk-control check; it is not a legal title search, professional due diligence or a guarantee of ownership.
You grant Blackfeet non-exclusive permission to use submitted descriptions, photographs and walkthrough videos to market the property while the listing is active. You remain responsible for having the necessary rights and permissions for that content.
Customer reviews must reflect genuine experiences. Reviews are moderated before publication, and Blackfeet may reject or remove content that is misleading, abusive, unlawful, irrelevant or contains private information.
6. Rental and purchase requests
Rental and purchase requirements are used to identify potentially relevant opportunities. Blackfeet does not guarantee that a match will be found, that a landlord or seller will accept an applicant, or that a property will remain available.
7. Service fees and tenant placement
Residential tenant-placement services require a KES 1,000 activation fee and a success fee equal to 15% of one month's advertised rent. Commercial tenant-placement services require a KES 3,000 activation fee and a success fee equal to 20% of one month's advertised rent. The activation fee covers listing preparation and marketing, is payable before activation and does not guarantee that a tenant will be secured.
The success fee becomes due when a prospective tenant introduced through Blackfeet enters into a tenancy, pays a deposit or rent, or otherwise takes possession of the property. Unless a written agreement states otherwise, an issued success-fee invoice is payable within seven calendar days. An introduction includes a lead or enquiry supplied through the website, WhatsApp, telephone, email or another Blackfeet marketing channel. The property provider must notify Blackfeet when an introduced lead proceeds and must not bypass Blackfeet to avoid the agreed fee.
Blackfeet may invite an introduced tenant to confirm the property, move-in date and source of introduction. A verified tenant response may be retained with the relevant enquiry history as supporting service evidence, subject to the Privacy Policy and applicable law.
7A. Property sale marketing fees
Sellers may choose a fixed-fee lead-generation package or request full sale marketing on commission. The fixed marketing fee is KES 3,000 for a residential home and KES 5,000 for land. Under the full-service option, the commission is 3% of the completed sale price for either a home or land, payable only upon a successful sale under an approved written marketing agreement.
A commission request does not automatically activate or publish a listing. Blackfeet must review the property and approve the agreement first. The agreement may set out the marketing period, the meaning of an introduced buyer, payment timing and other transaction-specific obligations.
7B. Verification and payments
Users are responsible for conducting independent legal, physical, planning, valuation and financial checks before entering a transaction. Never pay a deposit or purchase price solely because information appears on this website. Confirm the recipient, authority to transact and payment instructions independently.
8. Intellectual property
The Blackfeet name, website design, original copy and branding may not be copied or commercially reused without permission. Third-party property content remains subject to the rights of its respective owner.
9. Service availability
We may update, suspend or discontinue features, listings or access without notice. We try to keep the website accurate and available but do not promise uninterrupted or error-free operation.
10. Limitation
To the extent permitted by law, Blackfeet is not liable for losses arising from inaccurate third-party information, unavailable properties, independent negotiations, third-party services, user misconduct or decisions made without appropriate professional due diligence.
11. Governing law
These terms are governed by the laws of Kenya. Parties should first attempt to resolve concerns in good faith through direct communication before pursuing other remedies available under applicable law.
